How to Talk to Your Employer About Taking CBD

You may feel apprehensive about talking to your employer about taking a cannabidiol (CBD) supplement. Knowing that cannabis products have a complicated legal history, this apprehensiveness is understandable. Fortunately, there are hundreds of resources to help you and your employer better understand CBD, its benefits, and its potential risks. We are here to equip you with educational resources to put yourself, your HR representative, and your employer at ease. Here is some basic information to help you start the conversation:

CBD is legal.

The first and most basic thing your employer needs to understand is that CBD is legal. Hemp-derived CBD was decriminalized by the 2018 Farm Bill (linked at the bottom). This means that CBD is legal on a federal level; however, federal laws do not override state laws. We recommend checking the legality of CBD in your state before attempting to purchase a cannabidiol supplement. Get a doctor’s recommendation.

Once you are informed about the legality of CBD in your state, talk to your healthcare practitioner about your interest in incorporating CBD into your daily routine, and ask for a doctor’s note recommending the use of CBD. There is an ever-growing network of doctors and healthcare experts recommending CBD on a daily basis. Talk to your HR representative.

Now that you have adequate educational resources and your doctor’s recommendation, go to your HR representative. Be transparent about taking CBD, and reassure them about the safety of taking CBD if they are concerned. While a full-spectrum CBD oil will contain a small concentration of the euphorigenic phytocannabinoid THC, it does not offer euphoric effects. Research the specific brand, batch, and third-party test results to ensure you are taking a high-quality CBD oil. Knowing your CBD’s test results empowers you as a consumer and reassures your employer about the product’s integrity. Remember, CBD is a health supplement meant to help you live a more fulfilling life. If you're using CBD for a specific ailment any research you can bring forward to support your use will also be helpful.

Drug testing.

Now we run into the question of, “Will my CBD use trigger a positive drug test?” Using a CBD product with THC may yield a positive urine drug test result for THC metabolites. CBD, while it will show up on a drug test, is typically not one of the compounds drug tests screen for.  Unlike THC, it lacks intoxicating properties and poses no concerns to employers. However, the trace presence of THC within full-spectrum CBD products does carry some risk for a positive reading. The reading on a standard drug test will be minimal and is able to be identified by the issuing party. If you would like to avoid the risk, or if your employer is not comfortable with you taking a full-spectrum CBD oil, you can always opt to use THC-Free CBD or a topical CBD based cream. Neither of these will trigger a test.

Start the conversation.

You are equipped with resources, recommendations, and knowledge. Now it’s time to make your case to your HR representative and your employer.  If your job will be endangered by a positive drug test, do not take a full-spectrum CBD. If your company has strict policies on CBD, there’s a chance – despite your employer’s support – that they legally cannot make an exception due to corporate rules. And remember, there is strength in numbers. If a few of your fellow employees are interested in taking CBD then go to your HR department as a group. Together we can make CBD an acceptable supplement to a healthy lifestyle while still maintaining a company's policy and regulations.
